⭐ Who Qualifies for Tax-Exempt Purchasing?

We currently process tax-exempt purchases for:

  • Public & Private Schools
  • School Districts
  • 501(c)3 Nonprofit Organizations
  • Community Arts Programs (Community Arts Programs must operate under a recognized nonprofit or government umbrella to qualify.)
  • Government Agencies
  • Licensed Businesses with Resale Certificates

If your organization holds valid tax-exempt or resale status, we can apply it to your in-store purchases.

Below are the documents required for the state of Alabama to activate tax-exempt status linked to your customer account. Out-of-state resale certificates may require additional verification per Alabama law.

📚 For Schools (Public or Private)

To create your tax-exempt account, please provide:

  • State-Issued Tax Exemption Certificate
  • Photo ID of Purchaser
  • Proof of School Affiliation
    (school email, ID, or employment verification)
  • Completed Huntsville Art Supplies Tax-Exemption Form

🏦 For Government Agencies

Please provide: 

Agency tax exemption authorization
Government-issued employee ID

💛 For Nonprofit Organizations (501(c)3 and Similar)

Please provide:

  • IRS 501(c)3 Determination Letter
  • Photo ID of Purchaser

Tax-exempt documentation must be current and must be re-verified annually. You can provide your documentation in one of two ways:

Digital copies or photos of documents are acceptable, as long as all information is clear and readable.

You must bring a valid ID at the time of purchase. The purchaser’s ID must match the organization or provide proof of their authorized role.

Huntsville Art Supplies reserves the right to deny tax exemption for purchases that do not meet state requirements.

1. I'm an artist with a business license, do I qualify as tax exempt?

Short Answer:

No — business license and resale certificate are two separate pieces of documentation issued by the state.  Artists with a business license do not qualify for tax exemption if they are buying supplies for personal use, practice, or artwork they do not intend to sell.

🧾 Why? (Legal Explanation in Simple Terms)

Only items intended for resale or products that become part of goods for resale qualify for tax exemption.

A resale certificate allows a business to buy materials tax-free only if those materials will be resold in the same form or as part of a finished product.

That means:

Qualified for Tax Exemption

  • Buying supplies that will go into artwork intended for sale
  • Buying items to resell (like brushes, paints, kits, merch, etc.)
  • Buying components that become part of a product the business will sell
  • Buying materials used in creating inventory

NOT Qualified for Tax Exemption

  • Buying supplies to practice with
  • Buying for personal use
  • Buying for education or classes (unless the business is a tax-exempt entity)
  • Buying for portfolio building
  • Buying for projects that won’t be sold
  • Buying tools that are consumed and don’t become part of the final product (unless the state allows it — Alabama generally does not)

📍 Alabama Rule of Thumb

Alabama follows a standard:
If the supply becomes part of an item that will be sold
exempt.
If the supply is a tool or material consumed while creating the work
taxable.

So even if the artist has a business license, the tax exemption only applies when the purchase is directly connected to resale.

2. Do I need to bring paperwork every time I shop?

Only a valid ID that is associated to the exemption documentation. Once your documentation is received and approved, we attach your tax-exempt status to your customer account. Future qualifying purchases will automatically apply.  The paperwork must be submitted every year.

3. Can multiple people from my school, nonprofit, or business make tax-exempt purchases?

Yes! Just list each authorized purchaser in your form. Additional names can be added later as needed.

4. Can I mix tax-exempt and non-exempt items in the same purchase?

Yes — State law requires exempt and non-exempt items to be rung up separately.

5. What if I forget my documentation?

We must legally charge sales tax if your exemption is not on file.
You may bring or email your documents later and we can apply your exemption to future purchases once verified.

6. Can I return tax-exempt purchases?

Yes. Refunds will follow standard store policies.
Tax-exempt items can only be exchanged or refunded to the original purchaser on the account.

7.  How long does verification take?

Most approvals happen same day once documents are received.
In rare cases, additional verification may take 1–2 business days.
Alabama law requires the purchasing organization to provide documentation valid in the State of Alabama. Out-of-state resale certificates may require additional verification.
